ABI intervene in Simmons v Castle 10% General Damages Increase

The Association of British Insurers has intervened in the recent case of Simmons v Castle to ask for the judgment to be reviewed. The ABI rightly points out that the 10% uplift in general damages set down by Simmons v Castle applies to all cases, even those not affected by the changes to personal injury funding detailed in the Legal Aid, Sentencing and Punishment of Offenders Act 2012. The result is an anomalous position where it is in the interests of Claimants with claims currently running to avoid settlement until after April 2013. On this point a review of the judgment seems justified.
