Care Proceedings

Collins Solicitors has significant experience and expertise to provide legal advice to children, parents, Children’s Guardians and members of the child’s extended family when Local Authorities issue proceedings in relation to concerns about the care of children. This may be in relation to allegations of neglect, physical abuse, emotional harm, sexual abuse or where the child is alleged to be beyond parental control.

We have two Solicitors and one Legal Executive at Collins Solicitors who are able to represent adult parties in a sensitive manner throughout the often distressing court and assessment process. Paul McGinley and Donna Downes, Solicitors and Elaine O’Brien, Legal Executive.

Donna Downes is a member of the Law Society Children Panel which accredits her to also represent children directly and through their Children’s Guardian in court proceedings. She exclusively represents parties in cases concerning children.

Parents of children subject to care proceedings as well as the subject child or children are automatically entitled to publicly funded Legal Aid. Other relatives may be eligible for Legal Aid subject to means and merits tests.
